**1. Scope and Provider**
These Terms and Conditions (T&Cs) apply to all orders placed by consumers via the online shop of MASCHA IRIS ROTERMUND & LILIMOON by Mascha Iris Rotermund (www.rotermund.design, www.lilimoon.de). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or self-employed professional activity.
**2. Conclusion of Contract**
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. You may place products into the shopping cart and enter your details during checkout. By clicking the “Buy” button, you submit a binding offer to conclude a purchase agreement.
After placing the order, you will receive an order confirmation via email. This does not yet constitute acceptance of your offer. The contract is concluded only upon dispatch of the goods. You will receive a shipping confirmation including tracking information by email.
**3. Delivery and Production Time**
Available products are shipped within 2–4 working days within Germany and 2–8 working days within Europe. If a product is not in stock or is custom-made (e.g., with personalization or custom colors), production typically takes 2–3 weeks. Shipping follows the delivery times mentioned above.
**4. Prices and Shipping Costs**
All prices include VAT. Shipping costs are added and clearly indicated during the order process.
**5. Payment**
Payment is made using the methods offered during checkout, primarily via Shopify Payments and PayPal.
**6. Retention of Title**
Goods remain our property until full payment has been received.
**7. Right of Withdrawal and Exclusion**
Consumers generally have a statutory right of withdrawal. However, this does **not** apply to products that
- have been personalized with a name or initials, or
- have been custom-made using your individual color choices.
In these cases, withdrawal and returns are excluded unless we are at fault.
For all other non-personalized standard products, the statutory right of withdrawal applies. You can find the full withdrawal policy under “Right of Withdrawal”.
**8. Warranty and Liability**
Statutory warranty rights apply. We are fully liable only for claims arising from damage caused by us, our legal representatives or vicarious agents in the event of:
- injury to life, body or health,
- intentional or grossly negligent breach of duty,
- promises of guarantee (if agreed), or
- if the scope of application of the Product Liability Act is triggered.
**9. Applicable Law and Jurisdiction**
All legal transactions are subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods. If the buyer is a consumer residing within the EU, mandatory consumer protection laws of their place of residence may also apply.
